Temporary prohibited imports to Uzbekistan due to the pandemic
The negative impact of the global coronavirus pandemic has not spared the economy of Uzbekistan either. In order to ensure the safety of public health in 2020, it was necessary to introduce a number of restrictions based on the recommendations of the World Health Organization (WHO) and the situation in the country. This led to a decrease in the income of enterprises in some sectors and to some economic losses.
In this regard, the government has introduced temporary measures aimed at supporting economic entities and helping to restore the economic situation in the short term.
In particular, the Cabinet of Ministers of the Republic of Uzbekistan adopted a resolution "On measures to support local producers", adopted in January this year.
The measures are aimed at reducing the negative impact of the global coronavirus pandemic on the economy, reducing the factors limiting the production activities of enterprises in a number of sectors and industries due to the narrowing of trade markets, as well as expanding the volume and range of domestic industrial products aimed at creating a value chain in industrial production.
The document defines the procedure for compiling a list of goods produced abroad, as well as works (services) performed by foreign persons, whose participation in public procurement is temporarily prohibited and limited. The list of goods produced abroad, the participation of which in public procurement is temporarily prohibited and limited, as well as works (services) performed by foreign persons, has been approved.
The resolution also approved the Regulation on the procedure for preference of goods (works, services) of local production in public procurement.
According to the temporary regulation introduced by the decree, participation in public procurement for 529 commodity items in accordance with the code of the commodity nomenclature of foreign economic activity is temporarily prohibited and limited. Other private enterprises also cannot import these goods into the republic.
The main emphasis in the formation of the list of temporarily banned and restricted goods is made on the fact that they are produced by many local enterprises and their economic condition in the context of a pandemic is aimed at maintaining a stable state.
In case of receipt of an application for import on the basis of public procurement of goods (works, services), temporarily prohibited and limited, a proposal for an import permit on the basis of public procurement of goods (works, services) listed in the list agreed in the manner established by the relevant ministries, departments and organizations can be included in the list.
This decision does not restrict the constitutional rights of citizens, and the fulfillment by the state of its social functions in regulation of the sphere of public procurement is considered among the main goals.
It also does not contradict the basic principles of public procurement established by law.
Article 17 of the Law of the Republic of Uzbekistan "On Public Procurement" states that residents and non-residents of the country who participate as applicants for public procurement in the procurement procedure in the manner prescribed by law can become participants in procurement procedures.
Based on the principles of the procedure for conducting public procurement by participants, it was established that customers and suppliers participate in electronic commerce only with the use of an electronic digital signature.
The system also uses a mechanism to guarantee the execution of transactions through the Clearing House.
Instructions for using the system have been prepared for participants in public procurement, which are posted on the official website of the operator of a special information portal for public procurement.
